The article presents the results of a research that aims to problematize the scope and effects of the punitive logic and its way of “creating a world”, taking into account its individualizing and dichotomic/dichotomizing logic, especially considering its effects in terms of gender. In that sense, we analyze how the judicialization of the experiences of two women, Higui and Nahir, was socially problematized paying special attention to the way in which the roles of victim and perpetrator are assigned and the way in which the penal system, as a socio-techno-legal apparatus, produces and reproduces gender.
