HERMENÊUTICA, CONSTITUCIONALISMO E AS NECESSÁRIAS CRÍTICAS À DOGMÁTICA JURÍDICA

Resumo: O presente trabalho objetiva fazer uma análise do Constitucionalismo Contemporâneo – ou novo Constitucionalismo - a partir de sua incompatibilidade com a sobrevivência do positivismo jurídico clássico, em suas vertentes exclusivistas, posto que este configura-se como uma barreira ao próprio desenvolvimento do Estado Democrático de Direito, na medida em que finca pé na busca de uma espécie de vontade geral perdida. Sendo a força normativa da Constituição uma das principais características desse novo Constitucionalismo, que implementa obrigações positivas, o trabalho faz, ainda, uma análise da justiça constitucional na busca da concretização dos direitos constitucionais de várias dimensões e dos limites da hermenêutica constitucional, de modo que todas as formas de decisionismo e discricionariedades sejam ser afastadas.

HERMENEUTICS, CONSTITUTIONALISM AND NECESSARY CRITICS TO LEGAL DOGMATIC

Abstract: This article aims an analysis of the Contemporary Constitutionalism – or new Constitutionalism – from its incompatibility with classic legal positivism’s survival, in its exclusivist dimension, since it is configured as an barrier to the development of the Democratic State of Law, as strives in the research of an lost general will specie. As the Constitution’s normative power is one of the main characteristic of this new Constitutionalism, that implements positives obligations, the article analysis, yet, the constitutional justice in search of concretion of constitutional rights of several dimensions and the constitutional hermeneutics’ boundaries, so that all the ways of deciding and discretion are secluded.
