A ORTOPEDIA MORAL DA LEI: DIGNIDADE, LIBERDADE COMUNICATIVA E A DESCOLONIZAÇÃO DE DIREITOS HUMANOS

Resumo: O presente trabalho reflete a palestra proferida pelo autor na Universidade do Vale do Rio Sinos em ocasião do I Seminário internacional sobre pós-colonialismo, pensamento descolonial e direitos humanos na América Latina. Nessa oportunidade o autor discorreu sobre a noção de dignidade a partir dos diversos significado que o conceito adquiriu em sua trajetória histórica. Assim, o autor formula uma tipologia desses diversos significados pelos quais a dignidade é usualmente abordada. O autor argumenta, então, que existe uma verdadeira ortopedia legal da dignidade humana que busca arrancar o homem das condições de degradação.

THE MORAL ORTHOPEDIA OF THE LAW: DIGNITY, COMMUNICATIVE FREEDOM AND THE DECOLONIZATION OF HUMAN RIGHTS

Abstract: This work reflects a lecture given by the author at the University of Vale do Rio Sinos on the occasion of the first International Seminar on post-colonialism, de-colonial thinking and human rights in Latin America. On this opportunity the author talked about the notion of dignity from the various meanings that the concept acquired in its historical path. Thus, the author formulates a typology of this various means by which the dignity is usually addressed. The author argues, therefore, that there is a real legal orthopedcs of human dignity that seeks to tear the man of degradation conditions.
