CONSTITUINTE E LUTAS POPULARES: O MATERIALISMO DA CONSTITUIÇÃO E AS LUTAS PELA CONSTITUINTE EXCLUSIVA

Resumo: O presente trabalho visa à análise das relações entre as lutas populares pela instalação de uma Assembleia Nacional Constituinte exclusiva durante o período de redemocratização brasileira, entre as décadas de 1970 e 1980, e a recente retomada desta pauta pela atual campanha do Plebiscito Popular por uma Constituinte Exclusiva e Soberana do Sistema Político. Partindo de um referencial materialista e dialético, objetiva compreender estes processos e conceber o fenômeno constitucional desde a perspectiva da concretude política. Dessa forma, situam-se os processos constituintes e as Constituições como resultantes fundamentais de uma condensação material de uma correlação de forças, inserta em uma formação social concreta, em um dado momento histórico.

CONSTITUENT ASSEMBLY AND POPULAR STRUGGLES: THE MATERIALISM OF CONSTITUTION AND THE STRUGGLES FOR AN EXCLUSIVE CONSTITUENT ASSEMBLY

Abstract: The following essay aims to analyse the connexion between the popular struggles for convening an Exclusive Constituent Assembly during the recovery of Brazilian democracy – between the 1970s and the 1980s – and the recent resumption of this agenda for the current campaign of ‘Plebiscito Popular por uma Constituinte Exclusiva e Soberana do Sistema Político” (Popular Plebiscite on an Exclusive and Sovereign Constituent [Assembly] on the Political System). Trought a theoretical dialectical-materialist framework, aims to understand these processes and the constitutional phenomenon from the perspective of political concreteness. Thus, there are the constituent processes and the Constitutions as fundamental results of a material condensation of balance of power, inserted in a concrete social formation, in a specific historical moment.
