CONTRATERRORISMO E RESTRIÇÕES DE DIREITOS NOS ESTADOS UNIDOS PÓS-11 DE SETEMBRO:
UMA ANÁLISE DO ATO PATRIOTA

Após os atentados de 11 de setembro de 2001, o terrorismo passou a ser encarado nos Estados Unidos sob uma lógica securitizada, gerando uma ofensiva contraterrorista externa e interna com restrições aos direitos a partir da prioridade da derrota do inimigo. Internamente, o Ato Patriota configurou-se como um conjunto de alterações legislativas para ampliar poderes das agências de inteligência e do poder executivo na “guerra ao terror”. Tais emendas trouxeram incompatibilidades com a constituição estadunidense e a Declaração Universal dos Direitos Humanos, sobretudo aos chamados direitos de primeira geração. Amedrontada, a maioria da população apoiou esta medida que prometia segurança e combate ao terrorismo em troca da entrega de direitos. Este trabalho visa, através de análise documental dos itens supracitados e análise bibliográfica de artigos, contrapor o Ato Patriota à constituição estadunidense e aos Direitos Humanos para identificar possíveis pontos de restrição de direitos e, à luz dos resultados, refletir sobre os conceitos de público e privado do pensamento de Hannah Arendt.
