Resumo
El artículo explora el dinamismo histórico de la lucha por el empoderamiento popular del derecho humano, y de la Naturaleza, a la salud. Lo hace en el contexto de la violencia expropiatoria asfixiante desencadenada por la “plandemia” global de la Covid-19. Estructura el dinamismo en sus momentos de producción, circulación y apropiación. El paradigma jurídico utilizado para la indagación es el constitucionalismo horizontal iusmaterialista. Los casos escogidos como ejemplo son Bolivia y Ecuador (2020).

LEGAL OXYGEN OF THE PEOPLE. AN EXAMPLE OF IUSMATERIALIST HORIZONTAL CONSTITUTIONALISM IN TIMES OF PANDEMIC
Abstract: The article explores the historical dynamism of the struggle for popular empowerment of human rights, and of Nature, to Health. It does so in the context of the suffocating expropriation violence unleashed by COVID-19's global "pLandemia". It structures dynamism in its moments of production, circulation and appropriation. The legal paradigm used for the inquiry is the iusmaterialist horizontal constitutionalism. The cases chosen as examples are Bolivia and Ecuador (2020).
