BIG DATA AND DATA PROTECTION AND TRANSPARENCY:
THE CHALLENGE OF BUILDING TRUST AND GUARANTEEING CITIZENS’ RIGHTS

Abstract: Data collection and correlation make possible unintuitive discoveries and predictions about the world, and especially about society. The decision process arising from data correlations is not transparent. From such opacity, reasonable doubts arise about the correctness and fairness of the decisions made by the machines. This article aims to investigate the challenge of building trust and guaranteeing citizens' rights in the context of Big Data, as well as analyzing the need for greater transparency. The research, from a legal-sociological perspective, adopted the bibliographic technique and the procedure of content analysis. The research results point to the recognition of the indispensability and insufficiency of the normative instruments that regulate the data treatment in face of the complexity of the technological, political and social transformations experienced by the contemporary world.
