THE COMPULSORY VACCINATION AGAINST SARS-COV-2 AS AN INSTRUMENT FOR REALIZING THE RIGHT TO HEALTH
Abstract
The purpose of the article is to ascertain whether the mandatory vaccination against Sars-Cov-2 is a legitimate means of democratizing the right to public health in Brazil. To answer the question, experiences that occurred during the application of public policies for mass vaccination in Brazil were retrieved and the right to public health in Brazilian democracy and the parameters of vaccination adopted in the world to face the pandemic crisis were explained. Finally, it analyzes vaccination as an instrument for the realization of fundamental rights. The method used was the hypothetical-deductive and the technique of documentary bibliographic research. We conclude that the mandatory vaccination as a means of coping with the public health emergency resulting from the Coronavirus must be substantiated in evidence that the benefits of vaccination are greater than the risk of administering it and that the obligation is especially binding on the State that it should implement it responsibly and with clear information.
