THE (IN)COMPATIBILITY OF THE SOLUTION OF SOCIAL PROBLEMS THROUGH THE JUDICIALIZATION PROCESS OF POLICY AND CORPORATE RELATIONS IN BRAZIL AND CONSTITUTIONAL FETISHISM AS AN INHIBITORY MECHANISM POPULAR PARTICIPATION
Abstract
The present research seeks to present a study on the supposed incompatibility of the solution of social problems through the process of judicialization of politics and social relations in the Brazilian context. The objective is to seek to balance the scales between democracy and constitutionalism, between political participation and the realization of rights, clarifying that the Constitution establishes the relationship between the legal universe and the political universe. The work will employ an interdisciplinary approach, making use of the premises of sociology, political theory and law. In order to carry out the investigation, the deductive method was used, through bibliographic analysis. According to the study, it was possible to observe that the “constitutional fetishism” and the excessive judicialization of the politics and social relations proposed in this scenario of maximum effectiveness of the constitutional norms weaken the citizen participation and do not configure the adequate way for the construction of the solutions for the social problems that affect the Brazilian population.
