THE GRIEVANCE OF OBSTETRIC VIOLENCE AGAINST BLACK WOMEN AND THE PROMOTION OF PERSONALITY RIGHTS IN FRONT OF THE CONSTITUTIONAL PRINCIPLE OF EQUALITY IN BRAZIL

Reproductive rights derive from the inherent attribute of the human person embodied in reproduction and, therefore, constitute personality rights, and obstetric violence is the abusive conduct that violates these rights. This research aims to analyze whether there is an aggravation of obstetric violence suffered by black women due to racism and if so, investigate whether existing public policies are effective in reducing inequalities. For that, we used a hypothetical-deductive method, through bibliographic research. There are high rates of maternal mortality among the black population, as well as discriminatory treatment and inequity in care due to skin color, which aggravate obstetric violence. Still, there are public policies aimed at humanizing care and for the health of the black population, but which prove to be ineffective in combating racism in obstetric care.
