FEDERALISM AND THE RIGHT TO WATER
A STUDY OF INTERGOVERNMENTAL MEDIATION IN THE SÃO FRANCISCO INTEGRATION PROJECT
Abstract
ABSTRACT: Starting from the debate on the judicialization of fundamental rights and contrasting it with strategies for consensualization of conflicts within the scope of public administration, this article seeks to analyze, from a federalist perspective, the procedure for mediating inter-federative conflicts, conducted by the Attorney General of The Union (Advocacia General da União), between the Brazilian federal government and four states located in the Northeast Region, within the scope of the São Francisco River Integration Project. Through the empirical method of qualitative nature, a case study is carried out on the mediation procedure related to the project that impacts the access to water of more than 12 million people from 390 municipalities located in the Brazilian semi-arid region. The results indicate that, for certain types of cases, the mediation of inter-federal conflicts can reinforce fundamental rights and relevant public policies.
