THE RIGHT TO HOUSING AND THE SOCIAL FUNCTION OF PROPERTY: INSURGENT PLANNING IN THE NOVA ESPERANÇA COMMUNITY IN THE MUNICIPALITY OF CAMPO MAGRO (PR)

Abstract

This article presents an analysis of the land occupation bv Nova Esperança Community in Campo Magro (PR), which began during the 2020 pandemic by more than 1200 families on an abandoned public property. The occupation, coordinated by the Popular Movement for Housing, stands out for its fight for decent housing and the legal dispute surrounding it, focused on guaranteeing the social function of property. Socio-environmental, urban and legal analyses were carried out, highlighting the community's awareness of environmental challenges, especially because it is located in the Karst Aquifer region. The discussion highlights the contradictions of public administration in relation to environmental preservation and the social function of property. The insurgent occupation of the community redefines the environmental issue, highlighting its community organization, sustainable practices and struggles for rights. It is concluded that the community promoted the social function of property by consolidating a community life, highlighting the importance of insurgent planning in promoting counter-hegemonic alternatives. Furthermore, the importance of community participation and socio-environmental awareness in the construction of alternatives for the right to decent housing in challenging urban contexts is highlighted. The Nova Esperança Community represents an example of resistance and organization in the midst of socio-environmental and legal adversities.
