The position of the subject in the subjectivation by the state

Through discourse sequences extracted from two articles published in the news portals Extra and G1, communication media of Organizações Globo, we analyze in this paper, from the theoretical and methodological assumptions of Discourse Analysis as defined by Pêcheux, the meaning effects produced on the rights of transvestites and transsexuals in prison. In the juridical discourse, put into circulation by the journalistic discourse, the possible places for the transsexual/transvestite subjects are crystallized: the fact of being transvestites anticipates any meaning that can be produced about her/him; sex precedes her/him. The biological prevails causing a slip of the masculine to the feminine producing the meaning of a natural in-between place for these subjects. Their identities are built by the State almost exclusively from the natural meanings of criminality and prostitution, places always-already occupied by these subjects in journalistic/juridical discourse.
