Brazilian Prison System, social inequality and state omission: an analysis of violations of fundamental rights

Abstract

This article analyzes the permanence of violations of rights in the Brazilian prison system even after the recognition, by the Supreme Court, of the Unconstitutional State of Affairs in the judgment of ADPF nº 347. It starts from the understanding that the national penitentiary crisis is not limited to the deficit of vacancies, but involves structural precariousness, insufficient public policies and historical difficulties in guaranteeing basic rights to people deprived of liberty. Based on qualitative, bibliographic and documentary research, problems related to health, material conditions of custody and the limits of resocialization are examined. The social impacts of mass incarceration and the persistence of state omission in the face of a framework already recognized institutionally are also discussed. The results indicate that overcoming the prison crisis requires structural measures that overcome emergency responses and articulate prison policy, public health, and social inclusion.
