APPLICATION OF THE INTERCULTURAL LOGIC TO BRAZILIAN LAW: FOCUS ON INDIGENOUS TRIBES

The present work relate how do public law institutions work with indigenous affairs, especially the judiciary. Seen it, and analyzing critically the decisions and work of those institutions, which is a reflex of overall society prejudice, it’s proposed a solution to better resolve it. This solution states that if it’s used a multicultural, intercultural and relativist (concepts of philosophy of law) manner of viewing such affairs, it will be better for minorities, such as the indigenous people. And based on aspects of sociology and anthropology, observing human right as referral, is evidenced that the enforcement of monocultural manner only bring losses to a diversified society. Also, indigenous people comprehend a minority that suffers with monocultural establishments. Namely, the way to modify this reality is changing the basis of reasoning law and ideology of oppressive institutions.Downloads
