Abstract

Founded in a context of intense conflicts in the Bahian agrarian field, the Lawyers Association in defense of Rural Workers in the State of Bahia (AATR), in almost forty years of existence, coincides many points of its trajectory with the course of the Bahian agrarian question in that period and was constituted in an entity referenced in the set of Commons Legal Advice bodies (AJP) in Brazil. From this experience of AJPs we will establish a dialogue with the main trends that permeate the field of legal and political practices of popular advocacy in Brazil - Law Found in the Street and Insurgent Law. In our view, by different approaches, these tendencies treat the relation of the different interests in the State in dichotomous terms, either by reducing it to the institutional and the "official", or by a reading tending to regard it as an instrument of the ruling class, with consequences in the conceptions about the Law and its functionality in the capitalist social model.
