THE PERSPECTIVES OF MEDIATION IN INDIGENOUS FUNDS CONFLICTS ACORDING TO THE LAWS 13.105/2015 AND 13.140/2015

Land conflicts in Brazil have a historical origin, since the colonization period to the present day. In this litigation scenario, it is noted that a paradigm shift is necessary, permeating access to justice and social pacification. Thus, it is necessary to open other doors to aim for positive results in the issues pertaining to discussions over lands involving the indigenous. In the meantime, mediation can be a door to assist in these demands, contributing to the change in social practices. In order to demonstrate that mediation can be an effective mechanism in the resolution of indigenous land conflicts through the hypothetical deductive method using exploratory studies in doctrine, legislation and jurisprudence. As a result, we sought to demonstrate that mediation presents itself as an important mechanism for pacifying and resolving disputes involving the indigenous land issue.
