Abstract

This article aims to propose a critical reflection on the uses of the systems theory for the legal and social interpretation. To do so, an analysis with literature review is developed, the reception in the field of the Brazilian law theory of systemic theory from the luhmannian work demonstrating its limitations and contradictions and counterposing to this notion the potentialities of the analyzes developed by the lens of the dialectical historical materialist method for a more complete seizure, as a contribution to the theory of critical teaching of law in Brazil, enabling a result that represents the current situation of critical efforts on the theory of law in relation to systemic theory, dialectical historical materialism and the conception of the juridical form.

Possui graduação em Relações Internacionais pelo Centro Universitário das Faculdades Metropolitanas Unidas (2015) e em Direito pelo Centro Universitário de Volta Redonda (2020). Mestre em Ensino de Ciências da Saúde e do Meio Ambiente pelo Centro Universitário de Volta Redonda (2017). Doutoranda em Sociologia e Direito pela Universidade Federal Fluminense na linha de Instituições da Justiça e do Trabalho. É professora nucleadora no Núcleo de Internacionalização e Cooperação Interinstitucional do UniFOA, na Pró-Reitoria Acadêmica e professora dos cursos de Comunicação Social do UniFOA.
