Abstract

This article analyzes the role of sovereignty in International Law, recognizing it as an attribute of the State arising from the Westphalian system, and the deepening of its crisis, due to the innovations brought by cyberspace. The existence of sovereignty in the Modern Nation-State is covered, as well as its decline before the current international legal system, the emergence of new complexities as a result of the diffusion of cybernetic technologies, and the inherent visualization of the use of cyberspace as a matter of global concern. The method used is deductive, in a qualitative approach, with an exploratory objective based on bibliographical research, which reflect the necessary re-signification of sovereignty.

Marcelynne Aranha Almeida, Universidade Federal da Paraíba (UFPB)

Doutoranda em Ciências Jurídicas (PPGCJ-UFPB). Mestre em Direitos Humanos, Cidadania e Políticas Públicas pela UFPB, com ênfase nos estudos de Direito Internacional, conflitos armados e operações cibernéticas (2022). Pós-graduada em Relações Internacionais e Direito Internacional pelo IBMEC-SP (2020) e em Direito Civil e Processo Civil pela ESA OAB/PB (2022). Bacharel em Ciências Jurídicas e Sociais pela UFPB (2018). Consultora da UFRGS IHL Clinic, clínica brasileira voltada ao ensino, pesquisa e prática do Direito Internacional Humanitário. Membro da Equipe Editorial do Cadernos Eletrônicos Direito Internacional sem Fronteiras (CEDIsF). Foi membro da comissão de Direito Internacional da OAB-PB (2019-2020). Atuou como facilitadora-educadora da Agenda 2030 (Direitos Humanos e Objetivos de Desenvolvimento Sustentável) das Nações Unidas em projeto vinculado ao Ministério da Educação Italiano e ONU, na Scuola Caldiero A. Pisano, em Verona-Itália (2018). Durante a graduação, foi monitora de Direito Internacional Privado e desenvolveu atividades de extensão no Projeto Cidadania em Extensão: Acesso à Justiça e Mediação de Conflitos - MEDIAC, desempenhando atividades práticas e teóricas. Áreas de Interesse: Direito Internacional, Relações Internacionais, Direito Constitucional e Humanos, Direito Civil.
