The topic of inequalities has been widely analysed by the social sciences, and it is also the subject of investigation in its combination with the legal phenomena. Using the work of Robert Merton (1968), I extend the analogy of the “Matthew effect” to the law, based on the principle that it can function as a system of “rewards” distributed unequally and more favourable to those who already have better positions and advantages in the social system.
Two lines of reflection can be developed. The first concerns the relationship between the State, civil society, politics, and law. The second line of reflection delves into the question of whether freedom and equality are complementary to each other or, in contrast, are against one another, and what role and functions are played by law. The two lines of reflection share a set of ideas and questions organized around themes related to the reduction of social inequalities and social injustices, which can be operationalized within the framework of the “law and society” relationship.
