This paper analyzes the relation between law and public health, highlighting how public health information can strengthen legal arguments to go beyond the decriminalization of abortion on specific circumstances. In this context, the article proposes an interdisciplinary approach that combines legal reasoning with public health evidence. We use a review of sources from public health authorities, scientific research and case law as a method for analyzing how judicial decisions have incorporated public health developments and opportunities to expand this approach. Additionally, we propose the application of a proportionality analysis to demonstrate how public health information reinforces the need to advance decriminalization beyond the model of abortion based on specific grounds to more effectively protect human rights.
