ARE THE JUSTICE SYSTEM INSTITUTIONS REALLY “WORKING”?

THREE EVIDENCE IN THE OTHER SENSE FROM THE PERSPECTIVE OF A LIBERATION JUSTICE

Abstract

It starts from a prevailing state of injustice to problematize the existing dysfunctionalities in the Brazilian justice system. From the categories of people, need and self-determination proper to an intended Liberation Justice, three concrete problems are identified, for example: human disruption of the Public Defender's Office for the defense of the poor, lack of popular and social participation in the choice of the head of the Brazilian Public Ministry and the unconstitutionality and illegality of the conduct of investigation by the Supreme Court in clear violation of the accusatory system of separation of functions provided for in the Constitution and more recently by the Code of Criminal Procedure itself.
