In her work Memórias da plantação: episódios de racismo cotidiano, the theorist Grada Kilomba develops an important conception which conceals the negative attributions directed to black people, that is, Otherness. The condition of Otherness is a direct result of racism, and it determines the position of subalternity the black subject occupies in the social hierarchy thar comes from racial hierarchization. In the present study, by means of a bibliographical and documental research, discusses how this condition affects the way black people are treated by institutions, which create fatic obstacles that prevents them from accessing positions of prestige and power. It also investigates the role of Brazilian judiciary branch in reproducing Otherness through its institutional practices, especially the application of law in a discriminatory way due to the lack of greater participation of black people in its structure.
