‘NAMING THE COWS”:
THE DEBATE ABOUT THE FUNDAMENTALS OF HUMAN RIGHTS IN LIGHT OF THE JUDGMENT OF THE DIRECT ACTION OF UNCONSTITUCIONALITY NUMBER 4.983 BY THE BRAZILIAN SUPREME COURT

This article analyzes the decision of the STF that declared unconstitutional the law of Ceará nº 15.299/2013, which regulated the vaquejada as a sporting and cultural practice. For this, after the contextualization of the vaquejada practice and its cultural, political and economic shades, the universalistic and relativistic approach on human rights are confronted. From this, overcoming the universal/local dualism, a plural hermeneutic is adopted, allowing a conception inspired by the dialogue between different cultural practices that composes a complex, non-hegemonic vision of human rights. Given this, is argued that in the present ruling a dialogue of adaptation between the comprehension of the vaquejada and the protection of the right to the environment (wildlife) could be in stakesince the practice, in itself, does not implicates ipso fatoanimalsuffering. Starting from a dialectical and dialogical methodological analysis, with the exploration of bibliographic resources, the objective is to search the reasons behind the conceptions in dispute in the referred case.
