Abstract

The present study has as its central theme the social right to housing, proposing to investigate, in a broad way, the situation of disregard for this fundamental right in Brazil. In addition, the jurisdictional protection given to the right to housing is analyzed in a more detailed way, especially during the Coronavirus pandemic period. So, the research questions what is the role of the Judiciary in promoting and protecting the right to housing, in times of the Coronavirus pandemic? A deductive approach methodology, historical and monographic procedure methods are used, together with the indirect documentation search technique. As a result, it is noteworthy that the role of the Judiciary goes far beyond compelling the Public Administration to provide the essential benefits necessary to achieve the right to housing. Jurisdictional activity must, before that, ensure the full enjoyment of the right to housing, protecting it from possible interference.
