THE RIGHT TO THE CITY AS A BUNDLE OF FUNDAMENTAL RIGHTS

Abstract

The text examines the composition of the “right to the city” provided for in the City Statute and the importance of infra-constitutional law for the realization of the rights inherent to it.The right to the city is presented as a bundle of fundamental rights, densifying the conceptualization and the realization of these rights. For the realization of the rights that are encompassed in the bundle of the right to the city, there is complete federal legislation that allows its application. What must happen is to demand the social effectiveness of these rights, leaving the Government from its state of inertia, funding public policies and efficiently and quickly monitoring compliance with the City Statute.
