Abstract

Based on the ethnography developed in Buenos Aires’s criminal justice system, in this article I discuss what I call the production of legality in the investigative process. Considering the procedural reform that gave greater prominence to the public attorneys and separated the powers of investigation and judgment, previously concentrated in the role of the judge, I seek to address how prosecutors and police investigators invest themselves in the adaptation of the legal form of the various investigative procedures developed during the pre-trial stage. This discussion is also based on the method of comparison by contrast with the criminal system in Rio de Janeiro. From this perspective, I seek to contribute to the discussion of how different uses of the legal framework result in different ways of producing evidence, different relationships between the institutions of the judiciary system.
