Abstract

The Civic Appeal nº 1071628-96.2018.8.26.0100, from the Court of São Paulo, between the appellant Associação Centro Dom Bosco de Fé e Cultura and the appealed Católicas Pelo Direito de Decidir SC., brings a provocative participation of the Law on the process of deciding what is tolerable for the current brazilian society in regards to religious dissidence. Here we aim to present theoretical production regarding  the interaction between Law and religion, as well as the particularities of this relationship on Brazil and the rising judicialization of such conflicts, as a basis from which to try to understand the reasoning of this court case. Through unraveling the arguments used, this article proposes to comment on the presented scenario, questioning the role of the judicial system in resolving the dispute between reproductive rights and traditionalist religious doctrines.
