Abstract

This work aims to rethink the dichotomy between common sense and scientific
knowledge, presenting a comprehensive model called ethnomethodology, a phenomenological perspective that seeks to address activities, circumstances, and practical sociological reasoning as topics of empirical study, devoting to routine activities an attention usually given to extraordinary events. This perspective provides an epistemological status to common sense, which helps us to understand the social world and how we move in it. For law, this rapprochement with common sense is significant because it makes possible to perceive the legal phenomenon as a procedural social construction. In this sense, common sense is not an obstacle, as Bachelard said, but an epistemological bridge to understanding social reality.
