REPRODUCTIVE RIGHTS AND STATE'S MANAGEMENT OVER WOMEN’S BODIES
the Familiar Planning Law and voluntary sterilization

In this work we try to understand how the reproductive rights topic – in particular, of surgical sterilization – articulates with woman’s bodies self-determination and statal management over it. For this, we try to understand the context and parliamentary discussions had throughout the proceedings of the Familiar Planning Law (Law nº 9.263/1996) and it’s recent modification (Law nº 14.443/2022), responsible for voluntary sterilization being normalized in Brasil, by means of state documents, such as 1988 Federal Constitution, Law nº 9.263/1996, Law nº 14.443/2022, and documents produced along it’s processing, available at the National Congress diaries website, together with the 1992 CPMI (parliamentary inquiry commission) reports and documents and the Direct Action of Unconstitutionality (ADI) nº 5911, pending in the Brazilian Federal Supreme Court (STF). The aim is to reflect about this legislation different objectives and its possible effects. We do not pretend to overextend ourselves with a thoroughly documental analysis, which would allow for an independent work, but to bring an outlook which allows us to glimpse through the background curtains of statal body and sexuality management politics and, therefore, sterilization practices.
