Access to Information Laws in Latin America: a comparative analysis between Brazil and Argentina

Abstract

This article seeks to carry out a comparative analysis between the Laws on Access to Information in Argentina (Law Nº 27.275, of 2017) and that of Brazil (Law Nº 12.527, of 2011). Through the guiding question To what extent do the Laws on Access to Information in Argentina and Brazil are similar, and in what aspects do they differ, we seek to establish the socio-political context in which the respective legal rules were created and approved, in addition to specific analyzes of the law itself, by surveying the Center for Law and Democracy's Global Right to Information Rating Map. It is noticed that the laws are similar in several aspects, such as their right to effective information and their scope, in addition to the amount of time for their final approval. However, they do differ in central aspects, such as, for example, the internal organization of its regulatory bodies.
