THE CONDEMNATIONS FOR PHOTOGRAPHIC RECOGNITION AND THE INFLUENCE OF RACIAL SELECTIVITY IN THE BRAZILIAN PUNITIVE SYSTEM

Abstract

This paper aims to analyze the influence of racial selectivity in convictions based on photographic recognition in Brazil, by analyzing the jurisprudence of the country, the cases that gained national repercussion, and having as doctrinal basis the theory of labeling. The importance of the theme is justified by the need to denounce the racism and authoritarianism that permeate the practices of informal procedures in the criminal process and in the daily life of police stations, such as the disrespect for the legal procedure of personal recognition, present in art. 226 of the Code of Criminal Procedure, and the consequences resulting from this, such as the incarceration of innocent people, fruit of institutional racism. The methodology was developed by means of the deductive method, with qualitative analysis, through bibliographical review and jurisprudential research.
