THE JUDICIALIZATION OF AFFIRMATIVE ACTIONS IN BRAZIL

The slavery process, although ended many years ago, impacted several fields of human life, especially education, which will be discussed in this paper. Despite this exclusionary history, the adhesion to affirmative actions for access to Brazilian education is valid, having its constitutionality confirmed by the denial, by the Brazilian Federal Supreme Court, of the Claim for Noncompliance with Fundamental Precept 186/DF - ADPF 186, judged in 2012. The opportunity of Educational access is a social right guaranteed by the Federal Constitution that aims to transform the status quo, therefore, this research also aim to discuss the meritocratic conceptions that allow a perpetuation of inequalities.
