THE HUMAN RIGHT TO THE MEMORY OF HUMAN RIGHTS DEFENDERS:
a reflection based on transconstitucionalism

Among the various forms of violence that affect human rights defenders, the violation of the right to memory of the subjects of this group, who are victims of defamation, stigmatization and criminalization of their activities, stands out. Through the approach of transconstitutionalism and transversal rationality, the present work proposes to reflect on the possibility of different Latin American constitutional orders, with emphasis on Brazil and Colombia, to face together the need to preserve the memory of human rights defenders who were murdered. From a qualitative research, adopting the techniques of literary review and documental analysis on cases of violence against human rights defenders, it was possible to conclude that transconstitutionalism offers an important approach to the protection of human rights in the interaction between the experiences lived by different constitutional courts, especially with regard to the right to memory of human rights defenders.
