The IPCC reports are unanimous in predicting that there will be an increase in the impacts of climate change, corroborating that human activity, through the burning of fossil fuels, has warmed the earth since 1850. With this Scenario several aspects of human life and the environment have changed: acidification and rising ocean levels, extinction of several species, melting glaciers. Likewise, these changes have negative impacts on human rights such as food supply, drinking water, health and house. In Brazil, this scenario is reiterated by the disregard for environmental and climate policies that has further fueled this cycle of destruction into a true climate emergency. In this context, Brazilian climate litigation has stood out, since it is a fundamental way to focus the discussion of the various interest groups on a policy focused on a balance environment for present and future generations. This article carried out a study of the Public Climatic Civil Action brought by the Institute of Amazonian Studies (IEA) versus Brazil. The method chosen was the deductive and developed descriptive bibliographic research through publications of change and litigation climate in scientific articles published in the mains databases and relevant doctrine books. It is expected that in Brazil this Climate Civil Action will encourage discussion between civil society and interest groups on this urgent topic as well as the proposal of new climate actions.
