A PARTICIPAÇÃO DE ANIMAIS NÃO-HUMANOS EM PROCESSOS JUDICIAIS NO TRIBUNAL DE JUSTIÇA DO RIO GRANDE DO SUL

After detecting the recent phenomenon of strict legalization of Animal Law, in which non-human animals seek, in court, their rights, the problem of this research was to find out if animals have access to jurisdictional protection. With a geographic focus focused on the State of Rio Grande do Sul, due to the specificity of State Law No. 15,434/2020, through the deductive method, with documental consultation on doctrine and jurisprudence, the general objective is to analyze cases in which the Court of Justice of the State of Rio Grande do Sul recognized the quality of subjects with rights to animals, denying, however, their procedural capacity. Thus, the tendency of that court to affront the principle of the non-obviation of jurisdiction by denying the procedural capacity to the animals in question was detected.
