The present work aims at analyzing the perception of black people by brazilian society under a criminal law perspective. To this end, shall seek, albeit briefly, its historical origins as the construction of the image of the black people, the relevance of the discussion about race and your relationship with the right. Once defined the theoretical trait, from the myth of racial democracy, will be compared criminal norms that criminalize racial discrimination in the country in line with the constitutional text, to then allow a reflection on the imprescriptibility of such crime and the relevance of the limits of criminal law in the protection of ethnic-racial dignity.
