In this article, it has been reflected, women's participation in Brazilian electoral process and it's regulations that aim increasing their presence in legislative assemblies and executive branch, regarding throughout legal framework. Aiming to assess inconsistencies and the need for legislative innovations, it's first described ideological construction process that sustains male domination, by considering social labour structure based on the division of labour; moreover, the moral aspects that instituted patriarchalism and its consequences for women's participation in life are addressed; subsequently it is descripted efforts of the feminist movement in Brazil and, in concomitance, the sequencing of electoral process regulations and public resources usage by party legends; in conclusion, it is shown how far results' achieved were in relation to the ordinance objective and certain issues that should be normally appraised. Methodology was based on the historical-structural approach, including bibliographic and documentary research. In conclusion the women in brazilian politics modest participation, even after significant insertion in work force and growth in the condition as household head, finds answer in symbolically entrenched masculine domination in the legislative production directed to the question of gender in the political field.
