Abstract

This paper aims to revisit Frankfurt’s creation of urban zoning, back in 1891.Trying to avoid the dogmatism that surrounds the juridical discussion of the zoning law, the text intend to bring elements that allows a boarder analysis of the instrument. Analyzing the German context of the end of the 19th Century as well as the other urban policies taken by Frankfurt-am-Maim Administration, the article also aims comprehend zoning as a part of a public policy of the urban spatial regulation. Having as main elements the preservation of German’s industrial expansion and the safeguard for the realty owners of the city, this paper tries to demonstrate that zoning was born under the sign of the spatial exclusion. Moreover, zoning will help to preserve the surplus accumulation both of the industrial sector as the real estate market.
