CONSTITUTION, FUNDAMENTAL RIGHTS AND RULE OF LAW IN CONTEMPORARY RUSSIA
ENTRENCHMENTS BETWEEN THE POLITICAL TRADITION AND THE PROTECTION OF LEGAL RIGHTS IN RUSSIAN CONSTITUTIONALISM

The present work proposes a comparative study between the nomological and official discourse of the Russian constitution and the different approaches about the meaning of the Constitution and of fundamental and human rights developed by Russian constitutional scholars. As its main methodological strategy, it is presented a sampling of works and researches of Russian legal literature related to the constitution and its rights. This is contextualized and augmented by a discussion of the influence by the distinct political and cultural traditions at the equally multiple perspectives of contemporary Russian constitutionalism. As its main results, it is verified that not only the existence of conflicting positions in Russian constitutional culture, but the majoritarian presence of a weakening approach to the guiding and limiting role of legal rights as up to the dynamics and politics of the State as well, especially considering that a meaningful quota of Russian constitutional scholars seems inclined to adopt both discourses of justification of the sovereigntist practices of its centralized government and the defense of the primacy of the political authority regarding legal rights, the two of which are grounded at an identification of human rights’ discourse with the logics of hegemonic domination advanced by the European West.
