DO DIREITO À CIDADE AO ESTATUTO DA CIDADE: UMA ABORDAGEM DO PROTAGONISMO DOS GOVERNOS LOCAIS NA CONSTITUIÇÃO DE UM NOVO ESPAÇO URBANO PARTIR DA TEORIA DE HENRI LEFEBVRE
Abstract
The Right to the City, whose idea arises from the work of Lefebvre in the 1970s, began to permeate the urban debate in Brazil in the last two decades. From this, the central question of the article asks whether the Right to the City can be condensed into the legal principles of democratic management of the city, the social function of property and the fair distribution of burdens and benefits, under the preponderant responsibility of the municipalities. using the deductive approach method, the main premise is that the local governments have the greatest responsibility in the realization of this Right from these three founding principles listed as central in the City Statute from 2001 onwards. The work uses a bibliographic research technique and legislative, through a monographic procedure.
