COUNTERTERRORISM AND RESTRICTION OF RIGHTS IN THE UNITED STATES AFTER 9/11:
AN ALALYSIS OF THE USA PATRIOTIC ACT

After the attacks on September 11, 2001, the issue of terrorism was faced under the logic of securitization, creating a counterrorist offensive abroad and domestically with restriction of rights under the priority of defeating the enemy. Internally, the USA PATRIOT Act was configured as a set of amendments to increase the power of intelligence agencies and of the executive power on the “war on terror”. These amendments brought incompatibilities with the American constitution and with the Universal Declaration of Human Rights, especially concerning the so-called rights of the first generation. Frightened, the majority of the population supported this measure that promised security and fighting terrorism in exchange for rights. This paper seeks to face the USA PATRIOT Act to the Constitution of the United States and to human rights through documental analysis of the quoted documents and bibliographical analysis of papers to find points of restriction of rights and, under the light of the results, to reflect on Arendt’s concepts of public and private.
