The Mozambican penitentiary system: legislation and reality

The aim of this work is to examine the current state of Mozambique’s penitentiary system, describing the main challenges it faces and suggesting solutions to overcrowding, recidivism, and the prisoners’ re-socialization process. The article also aims to draw a parallel between the practical reality and what Law no. 35/2014 of December 31 (Mozambican Penal Code) establishes as the purpose of punishment. We discuss data from the Mozambican National Penitentiary Service (SERNAP) and from the National Enquiry into Incidence, Behavioral Risks, and Information on HIV and AIDS in Mozambique. We also consider the discrepancy between that which is laid out by the law and the practical reality, given how severely the country’s prisons violate the aforementioned provisions.
