THE VIEW OF HEALTH PROFESSIONALS REGARDING CURRENT AND FUTURE RULES ON THE RIGHT TO ABORTION IN BRAZIL:
pragmatism, conscientious objection and judicialization of politics at the interfaces between politics, law and medicine in hospitals in Grande Vitória - ES

This article is based on interviews with health professionals in Grande Vitória to reflect on the current rules on abortion in Brazil and their possible changes in the future. These changes can come through legislation or by judicial decision, through the so-called judicialization of politics. We aim to ascertain, among those interviewed, their opinion regarding the current rules, their possible transformations and whether these transformations should come from the Legislature or the Judiciary. As a result, it was observed that health professionals adopt a pragmatic stance on the topic. They approve the current rules and would adapt to possible changes by resisting expansions through the use of conscientious objection, or subjecting themselves to the obligations arising from a more restrictive rule. The same pragmatism is observed regarding the origin of change, that can come from the Legislature or the Judiciary, as the content of the change is more important for them, than its origin. Anyway, there are some firmer positions in favor of one origin or the other and strong claims for greater participation of medical expertise in eventual decisions on the topic, regardless of where they comes from.
