É tradição do direito brasileiro prever, nos processos judiciais, vantagens em favor da Administração Pública, sob o fundamento de que a supremacia do interesse público prevalece em certos casos sobre o princípio da igualdade das partes litigantes. De fato, o Estado, como parte processual, não deve ser tutelado como seu cidadão comum, porque a isonomia que se propaga com o princípio do Estado de Direito deve ser limitada pelas regras essenciais ao funcionamento e à própria existência do Estado. Não obstante, tais vantagens, na verdade prerrogativas, devem ser estritamente necessárias à compensação de desigualdades, sob pena de configurarem odiosos privilégios.Downloads
