FRAUD TO GENDER ELECTORAL QUOTAS
AN OBSTACLE TO SUBSTANTIVE DEMOCRACY

: Gender-based political violence consists of making it difficult for women to enter or remain in the political sphere, thus weakening democratic legitimacy by undermining the principles of equality, citizenship and political pluralism. In this way, fraud against electoral gender quotas is a form of violence against women, as it makes it difficult to achieve parity in political representation. Considering this, we sought to understand how the Rio Grande do Norte Regional Electoral Court (TRE-RN) has adjudicated cases of quota fraud, by surveying case law and comparing it with the most recent understanding established by the Superior Electoral Court. The research is descriptive, empirical and documentary in nature, and the case law was collected using the Methodology for Analyzing Decisions (MAD). As a result, it was found that the TRE-RN considered no case of fraud to be well-founded and did not align itself with the most recent leading case formed by the TSE in part of its decisions. Therefore, it can be concluded that the affirmative action of electoral quotas is insufficient to change the scenario of female under-representation in politics.
