ALTERITY AND SOLIDARITY
A CRITICAL DECOLONIAL DIALOGUE TO THE THEORETICAL COMMON SENSE OF THE JURISTS FROM THE WORKS OF LUIS ALBERTO WARAT AND ALAIN SUPIOT
Abstract
This Research Paper discusses the approximations between the alterity evidenced in Warat's work, and the solidarity proposed by Supiot, questioning: Does the proposal of solidarity in Supiot and the alterity in Warat have theoretical approaches to support a critique to the European hegemonic claim to dictate the content of human rights? It aims to analyze the categories indicated by the aforementioned authors. As for the specific objectives: a) to study Warat's proposal for the rights of Alterity; b) analyze the importance of solidarity as a legal principle as shown by Supiot; c) identify the contribution of Warat and Supiot's proposals for the fulfillment of human rights. The research is bibliographical in nature using the hypothetical-deductive method. It was observed that the proposals of Warat and Supiot are interrelated in order to indicate that, for the fulfillment of human rights, the European hegemonic pretension that evidences a fundamentalism of a communitarian nature must be refuted.
