THE FEDERATIVE ISSUE, PENITENTIARY SYSTEM AND FEDERAL INTERVENTION IN BRAZIL

The following paper intends to study the powers of the Union, states and cities in planning and execution of the penitentiary policy in Brazil. After a brief analysis of the particulars and the historical development of the federative system, we aim to evaluate if the constitutional allocation of legislative and material powers is suitable to the necessity of improvement in the penitentiary issue. The article also aims to investigate the structure of financing of the presidium policies and assess - based on data relative to the Union, state and city budget allocations - the urgency of structural changes and the redesign of distribution of power, bringing organizational propositions addressing the overcoming of the current situation.
