The Vargas Era and the trajectory of Brazil’s Supreme Federal Court: an institutional historical analysis (1930-1945)

Abstract

This article analyzes the process of institutional development undergone by Brazil’s Supreme Federal Court during the Vargas Era (1930-1945), by studying the institutional shifts to have taken place during the period. To do so, the work focuses on the significant legislative modifications, the trend toward jurisprudence and the fluctuations in the composition of the Supreme Court. We pay particular attention to the three periods characterizing the Vargas Era: the provisional government, the constitutional one, and finally, the Estado Novo [New State]. We conclude with several brief final considerations on the distinctive features of the Supreme Federal Court’s institutional development in the period under study. It is our aim to contribute to studies on Latin America’s supreme courts from a historical and interdisciplinary perspective.

Atualmente, é Professor Adjunto de Ciência Política do Bacharelado em Políticas Públicas da Universidade Federal Fluminense (UFF), no Instituto de Educação de Angra dos Reis (IEAR). Foi pesquisador visitante do Instituto de Estudos Sociais e Políticos, da Universidade do Estado do Rio de Janeiro IESP-UERJ (2012-2013). Foi bolsista Pós-Doutorado Junior do INCT-PPED, UFRJ e IESP-UERJ (2011-2012). Foi Pesquisador Visitante na area de Ciência Política e Administração da Universidade de Salamanca, Espanha (2011). Foi Professor Visitante da Escola de Direito da Fundação Getúlio Vargas - RJ (FGV DIREITO RIO). É Doutor em Ciências Políticas IESP/ Universidade Estado do Rio de Janeiro (2010). Foi Visiting Assistant in Research, Political Science, Graduate School, Yale University (Fall 2008, Spring 2009). É mestre em Estudos Internacionais - Universidade Torcuato Di Tella (2004) e possui graduação em Faculdade de Direito e Ciências Sociais - Universidade de Buenos Aires (2002). É Co-coordenador do grupo de pesquisa: Poder Judiciário na América Latina da Asociación Latinoamericana de Ciencia Política (ALACIP). Tem experiência na área de Ciência Política, com ênfase em Ciência Política
