Résumé

Dans l’histoire britannique des jeux de hasard, la façon dont le pays a abordé ce phénomène aux multiples facettes peut être divisée en différents moments, chacun d’entre eux orienté par une attitude sociale et politique propre en ce qui a trait à la manière dont est socialement perçue cette activité et dont elle doit être prise en compte par les pouvoirs publics. Dans cet article, nous ferons usage d’une approche historique et juridico-dogmatique des législations, doctrines et politiques relatives aux jeux de hasard pour présenter, analyser et cataloguer ces différents moments. Il s’agit d’exposer l’attitude générale afférente à ces jeux de hasard, ainsi que les transformations politiques, économiques et sociales ayant conditionné les différents moments en question et leur impact sur les normes et politiques de chaque époque. Nous avons finalement pu observer qu’en dépit des divergences entre la situation juridique et la réalité sociale des jeux de hasard au fil de l’histoire britannique, il est possible de mettre en lumière trois approches différentes de cette activité, à savoir la prohibition, un système restrictif de régulation sociale et un système libéral de régulation économique.

Doutor em Direito pela Universidade Federal de Minas Gerais (UFMG) com período sanduíche na Universidade de Kent (Canterbury/UK). Mestre em Direito pela UFMG (2017). Advogado. Foi orientador da Divisão de Assistência Judiciária da Faculdade de Direito da UFMG (DAJ/UFMG), de abril de 2015 a setembro de 2017, atuando junto ao Grupo de orientação de Direito e Processo Penal, sendo também seu coordenador entre novembro de 2015 e janeiro de 2017. Tem experiência na área de Direito, com ênfase em Direito Penal, Direito Processual Penal e Direito da Execução Penal. Bacharel em Direito pela UFMG (2014).
